At The Art of Healing, we want you to understand your rights, how your health information is protected, and what you can expect regarding the cost of your care.

You may review the information below at any time. Paper copies are also available upon request.

Client Rights

Your rights may vary slightly depending on the professional license of your therapist. Please review the section that applies to your clinician.

Marriage & Family Therapy Clients — LMFT/LAMFT

As a client receiving marriage and family therapy services, you have the right to:

  • Expect your therapist to meet Minnesota’s minimum legal requirements for education, training, and professional experience.
  • Review public records maintained by the Minnesota Board of Marriage and Family Therapy concerning your therapist’s credentials.
  • Submit a complaint about an LMFT or LAMFT to the Minnesota Board of Marriage and Family Therapy.
  • Know the cost of professional services before receiving those services.
  • Privacy and confidentiality within the limits established by Minnesota and federal law.
  • Receive services without unlawful discrimination.
  • Access your client records as allowed by Minnesota law, unless another law or a prior written agreement limits that access.
  • Be free from exploitation for the personal, professional, financial, sexual, or other benefit of your therapist.

Professional Counseling Clients — LPC/LPCC

As a client receiving professional counseling services, you have the right to:

  • Expect your counselor to meet Minnesota’s minimum standards for education, training, and professional practice.
  • Receive information about your counselor’s qualifications and credentials.
  • Know the cost of services before receiving them.
  • Receive an explanation of the services being offered and the expected course of treatment.
  • Participate in decisions about your treatment.
  • Request information about the methods and techniques used in your care.
  • Privacy and confidentiality within the limits of state and federal law.
  • Access your records as permitted by law.
  • Receive services without unlawful discrimination.
  • Be free from exploitation, including sexual, financial, emotional, or other forms of exploitation.
  • Ask questions about any assessment or evaluation used in your care.
  • Receive an explanation of assessment results when appropriate.
  • Discontinue or terminate services at any time, subject to applicable clinical and legal considerations.
  • Submit a complaint regarding your counselor to the Minnesota Board of Behavioral Health and Therapy.

Psychology Clients — LP

As a client receiving psychological services, you have the right to:

  • Receive services from a psychologist who meets Minnesota licensing requirements.
  • Receive information about your psychologist’s education, training, experience, and credentials.
  • Know the fees for services before receiving them.
  • Receive information about the nature and purpose of your treatment.
  • Participate in decisions about your care.
  • Privacy and confidentiality within the limits of the law.
  • Access your records as permitted by law.
  • Receive services without unlawful discrimination.
  • Be free from exploitation or abuse by your psychologist.
  • Ask questions about psychological testing, assessment, diagnosis, and treatment.
  • Receive information about alternatives to treatment when appropriate.
  • Discontinue services, subject to applicable clinical and legal considerations.
  • Submit a complaint to the Minnesota Board of Psychology.

Social Work Clients — LICSW

Licensed social workers in Minnesota are required to follow professional, ethical, and legal standards designed to protect clients.

As a client, you have the right to:

  • Receive professional services that are within your social worker’s education, training, and competence.
  • Receive information about fees and services.
  • Privacy and confidentiality within the limits of the law.
  • Receive services without unlawful discrimination.
  • Be treated with dignity and respect.
  • Participate in decisions about your care.
  • Access your records as permitted by law.
  • Be free from exploitation, abuse, or improper dual relationships.
  • Ask questions about your treatment and your social worker’s professional qualifications.
  • Submit a complaint regarding a licensed social worker to the Minnesota Board of Social Work.

Your Information. Your Rights. Our Responsibilities.

This notice describes how medical information about you may be used and disclosed, how you can access this information, and our responsibilities for protecting your privacy.

Your Rights

You have the right to:

  • Request an electronic or paper copy of your health record and other health information we maintain about you.
  • Ask us to correct health information you believe is incorrect or incomplete.
  • Request that we communicate with you in a specific way or at a different address.
  • Ask us to limit certain uses or disclosures of your information.
  • Request an accounting of certain disclosures of your health information.
  • Receive a paper copy of this notice at any time.
  • Choose someone legally authorized to act on your behalf.
  • File a complaint if you believe your privacy rights have been violated.

We will not retaliate against you for filing a complaint.

How We May Use and Share Your Information

We may use or disclose your health information as permitted or required by law for purposes including:

  • Providing treatment and coordinating care.
  • Billing and obtaining payment for services.
  • Operating and managing our practice.
  • Quality improvement, consultation, and supervision.
  • Public health and safety activities.
  • Reporting suspected abuse or neglect when required by law.
  • Responding to health oversight agencies, licensing boards, courts, law enforcement, or other government authorities when legally required or permitted.
  • Workers’ compensation or similar programs.
  • Other purposes permitted or required by law.

Other uses or disclosures generally require your written authorization.

Psychotherapy Notes and Certain Sensitive Records

Psychotherapy notes receive additional protection under federal law. Certain substance use disorder records may also receive additional protection under federal law.

When additional privacy protections apply, The Art of Healing will follow those requirements.

Our Responsibilities

We are required to:

  • Maintain the privacy and security of your protected health information.
  • Notify you as required by law if a breach occurs that may have compromised your information.
  • Follow the privacy practices described in the Notice of Privacy Practices currently in effect.
  • Provide you with an updated notice if our privacy practices materially change.

Good Faith Estimate

Your Right to Receive a Good Faith Estimate

If you do not have health insurance or choose not to use your health insurance to pay for services, you have the right to receive a Good Faith Estimate of the expected cost of your care.

A Good Faith Estimate can help you understand the expected charges for mental health services before or during treatment.

You may request a Good Faith Estimate before scheduling services.

When services are scheduled sufficiently in advance, The Art of Healing will provide the estimate within the timeframes required by federal law.

For ongoing therapy, a Good Faith Estimate may cover an expected course of treatment and may be updated if the expected services or costs change.

If you receive a bill from a provider that is at least $400 more than that provider’s Good Faith Estimate, you may be eligible to use the federal patient-provider dispute resolution process.
